The ShortSky services include but are not limited to mobile applications, websites, related software, and all content available on these platforms (collectively referred to as "ShortSky" or "Services").
This document ("Agreement" or "Terms") constitutes a binding contract between ShortSky and the individual or entity associated with your account ("You," "Your," or "User"). Specific services may have additional terms applicable to those particular services, which will be indicated on our website or application. If you enter into a contract for specific services with our affiliates or third parties, the relevant contracting entity will be identified within those specific terms. These Terms (including any service-specific terms) govern your use of ShortSky and apply to your relationship with the identified entity.
ShortSky is not intended for users under the age of 13 ("Children"). Children are prohibited from using our Services in any capacity.
Users aged 13 to 18 ("Teens") may only use the Services under the following conditions:
(a) Both the Teen and their parent or legal guardian agree to these Terms, and the parent or guardian supervises and grants permission for usage. By allowing a Teen to use the Services, you represent that you, as the parent or guardian, consent to these Terms and accept responsibility for all activities conducted through the Teen’s account.
These Terms constitute a legally binding agreement between you and us. By accessing or using our Services, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to comply with them. If you are between 13 and 18 years of age, your guardian must review and accept these Terms on your behalf. All content within the Services is owned, controlled, or licensed by ShortSky. To provide the Services, ShortSky may require access to the device you use to access the Services (e.g., phone, tablet, or computer). We may occasionally provide service updates. Updates may be applied automatically or require manual installation. Without updates, the Services may not function properly. We do not guarantee updates or continued support for all devices or systems. It is your responsibility to ensure your device meets our requirements.
This Agreement does not transfer ownership of ShortSky’s or any third party’s intellectual property to you. All rights, title, and interest remain with the original owner.
You may not and may not allow others to:
(a) Use automated methods (e.g., scripts, bots, spiders) to access or copy content from the Services without written permission.
(b) Use the Services in violation of this Agreement or applicable laws, or encourage others to do so.
(c) Use the Services in ways that harm us or other users.
(d) Attempt unauthorized access to any systems or data.
(e) Sublicense, rent, lease, or sell the Services without explicit consent.
(f) Charge others for access to the Services without our explicit consent.
(g) Imply endorsement by ShortSky of any products, services, or content without permission.
(h) Send unauthorized communications, including spam, through the Services.
(i) Make the Services publicly available for download or use.
(j) Alter or obscure any ownership notices (e.g., copyright or trademark).
(k) Misrepresent the source or ownership of the Services.
(l) Redistribute, sublicense, or misuse the Services without authorization.
(m) Attempt to disrupt the Services or interfere with their lawful operation.
(n) Use unauthorized tools to modify or exploit the Services.
(o) Overburden servers or interfere with others’ use of the Services.
(p) Develop plugins or components that interact with the Services unless explicitly permitted by ShortSky and in compliance with additional terms.
(q) Reverse engineer, decompile, or extract source code from the Services unless allowed by law or with prior consent.
Violation of these restrictions will result in immediate termination of your access to the Services, and you may be required to destroy any copies of materials made. Unauthorized use of the Services violates these Terms and may infringe intellectual property laws. ShortSky may use technological measures to prevent unauthorized access, and you agree not to disable or circumvent such protections.
ShortSky does not guarantee uninterrupted, secure, or error-free use of the Services. You acknowledge that you use the Services and any materials or content accessed through them at your own risk, and you are solely responsible for any resulting property damage or data loss.
ShortSky does not guarantee the availability, delivery, performance, or timing of any content or intellectual property within the Services. We are not responsible for service interruptions caused by factors beyond our control, including but not limited to natural disasters, fire, terrorism, weather, national emergencies, labor disputes, supplier issues, government actions, or legal compliance.
To the fullest extent permitted by law, we disclaim:
(a) That the Services will meet your requirements or that user content will remain accessible;
(b) That the Services will be uninterrupted, timely, secure, or error-free;
(c) That results from using the Services will be accurate or reliable;
(d) That content you submit will remain accessible on the Services.
The Services are provided “As Is” and “As Available,” with no guarantees or warranties except as explicitly stated or required by law.
In the event of any dispute, arbitration, or litigation arising from user actions (or inactions) related to this Agreement, you agree to fully cooperate with ShortSky to resolve the matter. Additionally, you agree to indemnify and hold ShortSky harmless against any claims, demands, actions, or liabilities resulting from your actions or inactions, including legal fees and attorney’s costs.
Even after termination or expiration of this Agreement, this obligation remains enforceable.
Either party may terminate this Agreement at any time, with or without cause. However, obligations intended to survive termination will remain enforceable. Upon termination, your access to the Services will be revoked. Continued use of the Services constitutes acceptance of these Terms and associated obligations.
If fraudulent activities are detected, including interference with or manipulation of ShortSky and its Services, ShortSky reserves the right to terminate access immediately without notice and may pursue legal actions to recover losses.
As ShortSky evolves, we may update or modify the Services and these Terms ("Updated Terms"). Changes may address functionality, free or paid features, security, or legal compliance. Your rights under these Terms will not be reduced without your explicit consent.
You agree that we may implement changes at our discretion. Security, legal, or regulatory updates may take effect immediately without prior notice. Unless otherwise stated, Updated Terms take effect upon posting. Continued use of the Services after updates constitutes acceptance of the Updated Terms.
ShortSky’s Privacy Policy governs the use of our Services and is incorporated by reference into these Terms. By using the Services, you acknowledge that internet transmissions are never completely private or secure and that any messages, content, or information exchanged with the Services may be intercepted or read by others, even if encrypted.
